Jury Verdict Favors K&N in Spectre Performance False Advertising Lawsuit, Awards K&N $7.3 Million
On November 1, 2011 a jury in the United States District Court for
the Central District of California (Eastern Division) returned in
favor of K&N Engineering, Inc. on all of their claims of false
advertising against Spectre Performance. The jury deliberated
for three hours then reached a unanimous verdict that Spectre
Performance had intentionally engaged in various forms of false
advertising. The jury awarded K&N $7,337,196 in compensation
against Spectre Performance, an importer of Chinese-made goods
including air filters. Spectre Performance is located in Ontario,
California and vetteweb.com lists Amir
Rosenbaum as Spectre's president.
On December 8, 2011 Honorable Virginia A. Phillips, United States District Judge released a Final Judgment and Permanent Injunction. This document states that K&N is also entitled to recover from Spectre its reasonable attorneys' fees and reasonable costs incurred. Given the lawsuit was filed by K&N two years ago these costs could be substantial. The document also provides some details of Spectre's false advertising. Spectre has 30 days to file a report with the court detailing how they have complied with the Permanent Injunction.
